1. About these terms

These Terms of Use apply to www.moduforma.in and to the design, supply and installation services provided by MODUFORMA by Designer's Elements ("MODUFORMA", "we", "us") in Pune and surrounding areas. By using this website, submitting an enquiry or booking an appointment, you agree to these terms. Your signed quotation or order confirmation forms part of your agreement with us. If it conflicts with these terms, the signed quotation applies.

2. Use of this website

• Website content, including designs, photographs, renders and text, belongs to MODUFORMA. You may not copy or reuse it commercially without our written permission.
• Images are for illustration only. Actual colours, textures and finishes may vary slightly because of screens, lighting and natural material variation.
• Please give accurate details when you submit a form. Do not misuse the website, for example by sending spam or attempting unauthorised access.

3. Consultations and design

• Design consultations, showroom visits and site visits are subject to availability. We will confirm your appointment by phone, WhatsApp or email.
• Site measurements are taken by our team before final drawings. Final dimensions and designs are based on the measured site, not on plans shared online.
• Design changes requested after drawings are signed off may affect the price and timeline.

4. Quotations

• Quotations are itemised and based on the agreed scope, materials, finishes and hardware.
• A quotation is valid for 15 days from the date it is issued. After that, prices may be revised to reflect changes in material costs.
• Taxes, civil work, electrical or plumbing changes, and any items not listed in the quotation are excluded unless stated in it.

5. Payment terms

Unless your signed quotation states otherwise, payments are made in the following stages:

• 20% advance at the time of booking.
• 50% on sign-off of the final drawings.
• 20% before delivery.
• 10% on installation, payable within one week of installation.

Production starts after the drawing sign-off payment is received, and dispatch takes place after the pre-delivery payment. Delayed payments may delay production, delivery or installation.

6. Delivery and installation

• We will share an estimated timeline once drawings are signed off. Timelines depend on the scope, material availability and site readiness.
• The site must be ready for installation, with civil, painting, flooring, electrical and plumbing work complete as advised by our team, clear access and power available.
• Delays caused by site conditions, changes requested by you, or events outside our control (such as strikes, natural events or supply disruptions) may extend the timeline.
• Please inspect the work at handover and tell us about any concerns so that we can resolve them promptly.

7. Warranty

• Warranty coverage and duration for cabinetry, shutters, hardware, accessories and appliances are as stated in your quotation or order confirmation.
• Brand-supplied hardware and appliances are covered by the manufacturer's own warranty terms.
• Warranty does not cover damage from misuse, water seepage or leakage, pests, unauthorised alterations or repairs, normal wear and tear, or natural variation in materials.
• To make a warranty claim, contact us with your order details and photographs of the issue.

8. Cancellations

If you cancel an order after booking, any amount already spent on design, materials or production may be deducted from the refund. Once production has started, customised items cannot be cancelled. We will discuss any specific case with you transparently.

9. Limitation of liability

To the extent permitted by law, MODUFORMA is not liable for indirect or consequential losses arising from use of this website or our services. Our total liability for any claim is limited to the amount you paid for the specific item or service concerned.

10. Privacy

Your use of this website is also governed by our Privacy Policy, which explains how we collect and use your personal data.

11. Governing law

These terms are governed by the laws of India. Any disputes are subject to the exclusive jurisdiction of the courts in Pune, Maharashtra.

12. Changes to these terms

We may update these terms from time to time. The latest version will always be on this page. Terms agreed in an existing signed quotation stay as agreed.
